Mandatory Retirement

Here in the U.S., the baby boomers are facing the prospect of continuing to work past mandatory retirement age. With the actuaries telling us that longevity is well past 65 and social security not being enough to live on, seniors are compelled to continue to work.

Although there are laws against age discrimination, anecdotal evidence (evidence claiming non-factual information and word of mouth recommendations and often used in place of Clinical or scientific evidence), proves otherwise.

So, anecdotal evidence suggests such laws are not enforced with great regularity and that finding jobs after a certain age can be very difficult.

There are places where a mandatory retirement age can be enforced.

I.E: The Roman Catholic Church applies mandatory retirement to Bishops (75yrs) and Priests (70). However, getting replacements is very difficult and they may stay on in a semi-retired role. Another may be, Pilots. Mandatory age (65yrs raised from 60yrs) because of safety factors. Others that may claim mandatory retirement:

Police (any law enforcement agency)

Firefighters

Air Traffic Controllers (hired after 1972)

Many feel that these rules should be revised.

Can employers enforce a  mandatory retirement age?

Employers typically don't have the right to remove an employee from work due to his or her age. Employment law also includes protection against discrimination based on race, gender, religion, disability or veteran status and makes provisions for the employment of foreigners.

Also, there are laws for our youngsters (teenagers) who want to work.

They can apply for ‘working papers'. They can't work in factories or operate heavy equipment. Check out Federal and your state laws.

As the Baby Boomers exit from the work force, it will create a tremendous burden on the younger generation to support the large and living longer retirees. In addition, skilled & experienced workers that our seniors once occupied will create a void.

Mandatory retirement is not necessarily a bad thing.

First, in your case, its not going to happen. However, for those who keep saying the Air Force is no longer accepting prior service are not completely correct. They have stopped for this fiscal year. This is direct from the Air Force for fiscal year 2011:

Is the Air Force taking Prior Service (PS)?

Prior Service (PS) is a direct duty assignment program, allowing a select number of separated individuals to return to active duty.

PS program is separated into two categories: Category I - return without consideration of years of service (YOS). Category II - YOS restriction. Both categories are direct duty hire only.

A prior service required skills list (PSRSL matrix) of select direct duty AFSC's is updated quarterly and posted on AF Portal (select AFRS page, Publications (from side menu), Procedural Guidance Messages, 900 - Prior Service). The desired return AFSC must be on the matrix in order for an individual to re-enter active duty.

The PS program will access a total of 250 applicants (including re-trainees) during FY11, on a first come, first served basis. The total accession is subject to change based on Air Force needs.

Individuals who hold the rank of E-4, and are fully qualified as a Security Forces Apprentice, 3P0X1, may apply to retrain as a 3P0X1B, Combat Arms, provided they are otherwise qualified. Those individuals who hold the rank of E-5, and are fully qualified as Combat Arms, 3P0X1B may apply, provided they are otherwise qualified.

Your Air Force Recruiter has a listing of jobs which we are currently looking for, based on the job you are qualified in, years of service, and your successful qualifying.

Right now, the Air Force doesn't NEED anyone for the rest of the year. However, October 1, the process will begin again and another small number of prior service will be accepted.
